The purpose of this page is to provide you with some information that will help the conveyance run smoothly and on schedule.
The responsibility of the attorney for the Lender is to protect the interests of said Lender. The mortgagor may, at his or her own expense, engage an attorney of his or her own selection to represent his or her own interests in the transaction. If you have retained your own attorney, please have your attorney notify our office that he or she represents you.
It is essential that you study your loan commitment letter carefully and follow the instructions contained therein. We are required to follow the lender's requirements strictly.
Pay special attention to the insurance requirements contained in the commitment letter and review the documentation provided by your insurance agent to assure yourself that it complies with the exact requirements of the commitment letter. If the commitment letter requires proof of payment for 12 months of insurance coverage, be sure that your policy or receipt clearly states that you have paid for one year of coverage. Please take note that certain lenders require a minimum rating for any insurance company providing hazard insurance coverage in residential mortgage loans.
Prior to closing, please call our Real Estate Department to review the information contained in the insurance policy or binder with us or if you have access to a fax machine, please fax us a copy to review; this should avoid unnecessary delays in the event the policy or binder does not conform to the lender's requirements. Please bring the original insurance binder with you to the closing.
Please review your Purchase and Sale Agreement for specific requirements of your transaction. Please be prepared to pay for fuel oil adjustments or other adjustments to be made at the time of closing, by separate check. Prior to closing, please bring to our attention any unusual adjustments you anticipate.
Normally, the closing cannot be firmly scheduled until 3 to 5 full business days after we have been advised of all the necessary information to be provided by the Seller, and our receipt and review of the title examination, plot plan, municipal lien certificate, and the lender's final approval of the mortgage. Kindly check with our office to confirm the date, time, and location of the closing. All buyers, mortgagors, and co-signers, (if applicable) must personally attend the closing. A closing can take from 30 to 60 minutes to complete. Kindly contact the Real Estate Department within our office the day before the closing to review our calculations of all closing costs and expenses. Any balance to be paid by the Borrower must be paid at the time of the closing in CASH, or by CERTIFIED, CASHIER'S, TREASURER'S, or BANK CHECK, made payable to yourself or to the firm of Deschenes & Farrell, P.C. We can assist if you need to send a wire.
Please notify us immediately if the name and address that appears on your commitment letter and on this letter varies in any way from your legal name and the correct property address.
If there is a language barrier, kindly bring an interpreter to the closing.
Pursuant to the Patriot Act, you are required to bring an acceptable form of photo identification that has not expired. (Acceptable forms of identification are: passport, driver's license, military ID )
